TRIFERMED would like to inform the users of our website www.trifermed.com (hereinafter, “Web”) about this extended information on the data protection (hereinafter, “Privacy Policy”) by which we provide you information about the processing of your personal data  in a simple and a transparent manner, the purposes of the processing of your personal data, as well as the personal data rights that you can exercise. This Privacy Policy together with the Cookies Policy is available for the users of the Web.

(hereinafter, “TRIFERMED”), is the responsible company for the processing of your personal data, constituted according to the Spanish Laws, addressed in Avenida Torreblanca 57, 0812 Sant Cugat del Vallès (Barcelona) and registered in the Mercantile Register of Barcelona in Volume 34732, Book 148, Page B 248259 and holding the Tax Identification Number (CIF) B-62.917.141. 2. WHAT ARE PERSONAL DATA AND PROCESSING?

Personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing means any operation which is performed on personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction of your personal data.  

3. WHAT KIND OF PERSONAL DATA DO WE COLLECT?

In order to be able to process the personal data specified in this Privacy Policy, we need to collect certain information about you. Therefore, we gather information that you provide us through the registration form for the Trifermed Awards, and/or e-mail or telephone number available on our website. 

The data that we collect through the channels mentioned above are your name and surname, e-mail address, name of the company you work, and any other kind of information that you have provided us by the phone number or e-mail address available on our website.

A) Right of access

If you exercise this right, TRIFERMED will stop processing your personal data, being able to anonymize or eliminate it, unless we prove that the legitimate grounds for the processing prevail over your interests, rights and freedoms, such as their preservation during a reasonable period of time for the exercise or defense of any claim.   

D) Right to erasure

This right allows you to cancel your personal data. This does not mean that your data is completely eliminated, but that your data will be kept blocked in order to prevent the processing, without prejudice of making it available to the public administrations, judges and courts, for the attention of possible responsibilities that may have arisen from the processing during the prescription term. Once that period is over, your data will be duly anonymized or eliminated.

E) Right to portability

You have the right to receive your personal data, which you have provided to TRIFERMED and transmit that data to another controller. It is only possible to exercise this right when the processing is based on the performance of a contract or in your consent and the processing is done by automatic means. 

F) Right of restriction of processing

This right allows you to request the restriction or the suspension of processing of your personal data when:

  • You have contested the accuracy of the personal data, for a period enabling TRIFERMED to verify the accuracy of the personal data; 
  • You have exercised your right to object the processing of your data, while is verified that the legitimate interest of TRIFERMED prevails over yours.  

Also, this right allows you to request TRIFERMED to keep your personal data when:  

  • the processing is unlawful, and you oppose the erasure of the personal data and request the restriction of their use instead. 
  • TRIFERMED no longer needs the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defense of legal claims.   

G) Right not to be subject of a decision based solely on automated processing

This right allows you to ask not to be subject of a decision based solely on the automated processing of your data, including profiling, when this decision produces legal or contractual effects that will affect you.

We inform you that, in case you believe that TRIFERMED has not properly satisfied the exercise of your rights, you will be able to fill a complaint in front of the Agencia Española de Protección de Datos (AEPD), established in calle Jorge Juan, nº 6, 28001, Madrid (Madrid). 6. PROCESSING OF YOUR PERSONAL DATA

In any case, this legitimate interest is based on an analysis of the proper balance of our interests in dealing with your personal data and your rights and freedoms.
  • Your consent: in the event that TRIFERMED wishes to process your data and that processing can´t be based on any of the basis explained above, we will request your consent for such processing. 1. Registration for the Trifermed Awards

To manage the registration for the Trifermed Awards.  To manage any incidence related to the registration for the Trifermed Awards.  The legitimate basis for the processing of your personal data is the express consent that the user provides to TRIFERMED upon registration to the Trifermed Awards through the available form at the website.  Your personal data will be processed by TRIFERMED as long as the user does nor request the erasure or objection of his/her personal data.  Subsequently, the personal data provided shall be maintained duly blocked during the period of legal prescription stipulated for actions that may arise as a result of or in connection with the data processing.  Once the period for processing the personal data of the user is over, they will be anonymized or erased by TRIFERMED. You will be able to exercise the rights described in paragraph 5 of this Privacy Policy, as stipulated in that paragraph.   

2. Capture and use of the personal images of the attendees to the Trifermed Awards

Why do we use your data? Which is the legitimate basis for the processing of your data? For how long will we keep your data? Which are your rights and how can you exercise them?
Dissemination and exploitation of your image by the photographs or videos on the TRIFERMED corporate website and/or any other means. 
The legal basis for the processing of your personal data is the express consent that the user provides to TRIFERMED for the capture and use of his/her image during the celebration of the Trifermed Awards.  Your personal data will be processed by TRIFERMED as long as the user does nor request the erasure or objection of his/her personal data.  Subsequently, the personal data provided shall be maintained duly blocked during the period of legal prescription stipulated for actions that may arise as a result of or in connection with the data processing.  Once the period for processing the personal data of the user is over, they will be anonymized or erased by TRIFERMED.

3. Response to doubts and queries.

Your personal data will be processed by TRIFERMED as long as the user does nor request the erasure or objection of his/her personal data.  Subsequently, the personal data provided shall be maintained duly blocked during the period of legal prescription stipulated for actions that may arise as a result of or in connection with the data processing.  Once the period for processing the personal data of the user is over, they will be anonymized or erased by TRIFERMED.

4. Analysis of the use, operation and improvement of the Web.

Maintenance of the safety and protection of the corporate Web form malicious uses.  
Adapt the Web to the device that is being used. 
Show the correct content of the Web, requested by the user. 

The processing of personal data that are necessary for the correct functioning of the corporate website are made on the basis of the legitimate interest of TRIFERMED.  When the processing the personal data is not necessary for the correct functioning of the Web, TRIFERMED will request user´s consent.

We will keep your personal data for the period that each type of cookies requires or until you withdraw your consent to the use of cookies or exercise you right to object.  Once the period for processing the personal data of the user is over, the data will be anonymized or erased by TRIFERMED.

5. Maintenance of updated deletion lists in order to avoid being contacted if the user requests so.

Storage of your information in a deletion list, in case you have objected to a data processing or you have exercised the right of erasure.   Legal obligation: Article 24 of the  Regulation (EU) 2016/679 of the European Parliament and the Council, of 27 of April, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC obligates us to respect your rights and to maintain evidence of compliance when you exercise the right to erasure or to be forgotten.   Article 96.5 of the general Law for the Protection of Consumers and Users (Decreto Legislativo 1/2007, de 26 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias), obliges us to keep at least for one year the data of the users that have exercised their rights to erasure or to be forgotten. We will store your personal data during the legal prescription period of the actions that might be exercised in relation to the effective or deficient response that we have given to the right of erasure and objection.    Once the period for processing the personal data of the user is over, the data will be anonymized or erased by TRIFERMED. The rights described in paragraph 5 of this Privacy Policy are restricted, due to the fact the this is a processing based in a legal obligation as explained in paragraph 5. 

6. WHO DO WE COMMUNICATE YOUR DATA TO?

  1. TRIFERMED does not communicate your personal data, unless it is strictly necessary for the correct performance of its services. If you give your consent for the capture and use of your image during the celebration of the Trifermed Awards, your personal image might be communicated to third parties, which are specially linked to the company.

Moreover, TRIFERMED might communicate your data when obligated by law.

  1. We will also be able to communicate your personal data in the following cases: 
  • If we or substantially all our assets are acquired by a third party in which case, the personal data we have of our clients and users will be one of the assets transferred. Any such operation shall be informed and communicated in advance.
  • In order to protect the security and rights of our staff, our customers and users and our information systems. This includes exchanging information with security forces or Courts in cases of fraud detection, identity theft or any other use, processing or illicit act. 

7. WHO HAS ACCESS TO YOUR PERSONAL DATA?

TRIFERMED informs you that we work with third providers necessary for the correct usage of the Web. They might have access to your personal data when performing their activity. Those providers are for instance, the ones that help us to improve and optimize our Web, providers of technological services or companies providing services of maintenance of our databases

8. IS YOUR PERSONAL DATA SAFE?

In order to ensure a fair and transparent processing of your personal data, we adopt the appropriate procedures which will include the implementation of technical and organizational measures that take into account the possible risk and that correct any identified imprecision when processing personal data, so that the risk of any error is minimized, processing your data in a fair and safe manner. 

All the information you provide is stored on secure servers. Unfortunately, the transmission or communication of information through Internet is not completely safe. Thus, once we have received all your information, we will use strict security procedures in order to try to avoid any unauthorized access. 

We also make sure that our service providers have adequate safety standards for the protection of personal data for which they have or may have access, according to the applicable data protection regulations. 

9. CHANGES TO THIS PRIVACY POLICY

We may amend the information contained in this Privacy Policy due to possible changes in the criteria followed by the Spanish Data Protection Agency, the legislative changes that might take place and the applicable Case Law. Therefore, TRIFERMED reserves the right to amend this Privacy Policy in order to adapt it to those criteria, as well as legislative and Case Law novelties.
